not be expected to create these types of noise problems. However, in the event that the clientele
create these kinds of problems, staffhas conditioned the project so that if there are any future
complaints regarding noise levels due to shouting, fighting, vehicles, etc., the project can be
reviewed again to add mitigating conditions of approval. Such conditions could include the
hiring of security guards to patrol the parking areas, reducing the hours of operation, and/or
eliminating the use of the outdoor patio area(s) for alcoholic beverage consumption.
Furthermore, as stated above, staff has proposed a condition of approval requiring the review of
the use permit in six months, at which time noise (and other potential issues) will be evaluated.

On-street public parking is allowed on Walnut Drive and the south side of Ray Street. These
parking spaces abut several residences. The restaurant/bar would be open until midnight or 1:00
a.m., and there is the potential that the residents on Ray Street and Walnut Drive could be
disturbed by late-night patrons who park on Ray Street or Walnut Drive. However, with the
parking conditions implemented as discussed above, staff believes the potential for impacting
the residences on Ray Street and Walnut Drive would be minimized. Staff has included a
condition of approval that requires the applicant to notify her patrons to park in the subject site's
parking lot, in the US Bank employee parking lot, or in the on-street parking spaces on Main
Street or to use the valet parking service. A condition also requires that the applicant install
small signs near the exit doors requesting that customers not loiter outside and to be courteous
and quiet when leaving the business and parking area.

V. PUBLIC NOTICE

Notices regarding the proposed conditional use permit application and related public hearing
were mailed to property owners and tenants within 1,000 ft. of the subject property. At the
writing of this report, four people have contacted staff regarding the proposed application: Chris
Beratlis, owner of several Downtown properties; Lee McWilliams, resident of 340 Ray Street;
Christine Cardullo, resident of 304 Ray Street; and Nanette Vogel, resident of 503 Saint John
Street. As noted above, Chris Beratlis is concerned with potential problems caused by late-night
customers and suggested that the late-night hours be approved on a limited, trial basis only. Mr.
McWilliams, who lives directly behind 780 Main Street, indicated that he was concerned that
the proposed late night alcohol service would increase noise and that he was opposed to the
proposed application. He indicated that he already has problems with noise from live bands at
the Pleasanton Hotel and people leaving the parking lots at Coffee Roast Express and Pleasanton
Main Street Brewery. In the attached e-mail, Ms. Cardullo indicates that she feels that the
proposed late-night alcohol service would increase noise, traffic, and street parking on Ray
Street and requests that the application be denied. In Nanette Vogel's e-mail, she indicates that
she has been to the applicant's Danville restaurant on several occasions, that it seems like a very
respectable restaurant/pub, and encourages the Commission to approve the application. As
discussed above, staff believes that the recommended conditions of approval would ensure that
the surrounding uses are not impacted due to noise, parking, litter, or other objectionable

Page - 8
