Page 1 of 3 <br />Item #10 <br /> CITY COUNCIL AGENDA REPORT <br /> <br />April 21, 2026 <br />Police <br /> <br />TITLE: (1) RECEIVE THE ANNUAL MILITARY EQUIPMENT USE REPORT FOR 2025; (2) <br />INTRODUCE AN ORDINANCE AMENDING ORDINANCE NO. 2238 TO AMEND <br />THE PLEASANTON POLICE DEPARTMENT'S MILITARY EQUIPMENT USE <br />POLICY TO ADD EQUIPMENT TO THE POLICY'S MILITARY EQUIPMENT <br />INVENTORY; AND (3) ADOPT A RESOLUTION ACCEPTING THE ANNUAL <br />MILITARY EQUIPMENT USE REPORT FOR 2025 DETERMINING THAT THE <br />CITY'S USE OF MILITARY EQUIPMENT IN 2025 COMPLIED WITH THE <br />STANDARDS OF APPROVAL AND RENEWING THE MILITARY EQUIPMENT <br />USE POLICY <br /> <br />SUMMARY <br />Assembly Bill 481, codified as Government Code sections 7070 through 7075, requires a law <br />enforcement agency to obtain approval from the City Council, by adoption of a Military <br />Equipment Use Policy by ordinance, prior to funding, acquiring, or using military equipment as <br />defined in the law. The law further states that the governing body shall review the ordinance it <br />has adopted pursuant to this section annually and vote to renew it at a regular meeting. <br /> <br />RECOMMENDATION <br />(1) Receive annual military equipment use report for 2025; (2) introduce and waive first reading <br />of an ordinance amending Ordinance No. 2238 to amend the Pleasanton Police Department’s <br />Military Equipment Use Policy to add equipment to the policy’s military equipment inventory; <br />and (3) adopt a resolution accepting the Annual Military Use Report for 2025 determining that <br />the Pleasanton Police Department’s use of military equipment in 2025 complied with the <br />standards of approval and renewing the Military Equipment Use Policy. <br /> <br />BACKGROUND <br />Assembly bill (AB) 481 was enacted in 2021 to create consistency for the funding, acquisition, <br />and use of military equipment by law enforcement agencies and to increase transparency, <br />accountability, and oversight. <br /> <br />The bill requires a law enforcement agency to obtain approval of the applicable governing body <br />(City Council) by adopting a Military Equipment Use Policy, as specified, by ordinance at a <br />regular meeting held pursuant to specified open meeting laws, prior to taking certain actions <br />relating to the funding, acquisition, or use of military equipment as defined. Approval was <br />received and the ordinance was adopted by the City Council on July 19, 2022. <br /> <br />The bill also requires an annual review by the City Council to renew or disapprove the <br />acquisition of this equipment, to create a Military Equipment Use Policy, and to publish that <br />policy on the agency’s website. <br /> <br />The Annual Military Equipment Use Report for 2025, which includes the military equipment <br />Page 147 of 846
