the right-of-way, including utility purveyors operating within Pleasanton, such as PG&E, AT&T,
Comcast, and others. When a right-of-way is not used for its intended purpose, state law
allows a simplified “summary” vacation process. The right-of-way beneficiaries have the right
to protest the planned vacation.

Staff provided formal notice to each potential right-of-way beneficiary requesting confirmation
of any objection to the proposed vacation. No objections were received within the prescribed
response period. The City Council, as a legislative body, has been granted the authority to
summarily vacate the right-of-way that is no longer necessary or relevant.

Adoption of a Resolution of Summary Vacation for Right of Way (Attachment 4), together with
the recordation of Tract Map 8724, effectuates the modification of the right-of-way.

CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA)
On March 18, 2025, the Zoning Administrator determined that the 2023-2031 (6th Cycle)
Housing Element Update Program Environmental Impact Report, pursuant to CEQA
Guidelines Section 15183 Consistency Checklist for the project, was adequate to serve
as the environmental document for this project and satisfied all the requirements of
CEQA.

EQUITY AND SUSTAINABILITY
Not applicable, as this item is an administrative matter of City business.

OUTREACH
Approval of the development application involved public hearings before the Zoning
Administrator, Planning Commission, and City Council. Condition of Approval 25 of Resolution
No. PC-2025-14 requires the subdivider to notify neighbors within 300 feet of the project site of
the construction schedule.

Notification letters were sent to right-of-way beneficiaries as required by California Streets and
Highways Code §8335(b)(5). No beneficiary submitted an objection to the proposed right-of-
way vacation.

STRATEGIC PLAN ALIGNMENT
Approval of this action advances the citywide ONE Pleasanton strategic goal of Building a
Community Where Everyone Belongs.

FISCAL IMPACT
This development is expected to generate the approximate revenue from impact fees:
