Recording the notice triggers a 30-day window for
subcontractors and suppliers to serve stop payment notices to secure unpaid project funds. If we do not record a notice,
claimants have 90 days to file after project completion.

Regardless of whether we record a notice, per Public Contract Code section 7107, a public agency must release undisputed
retention proceeds within 60 days of the “date of completion.” Based on the invoice below, it looks like it’s been more than 60
days. No need to record a Notice of Completion at this late date, but we should pay the contractor the 5% retention ASAP (to
avoid statutory penalties of 2% per month.)
-Julie

From: Pleasanton City Clerk <pleasantoncityclerk@cityofpleasantonca.gov>
Sent: Tuesday, August 11, 2026 12:49 PM
To: Contracts <contracts@cityofpleasantonca.gov>
Subject: Notice of Completion for public works contract

Hello,

We received the below request from Public Works to record a notice of completion (NOC) for a construction contract of $56K.
