City of Pleasanton
Landscape Maintenance District No. 1993-1, Windsor
Engineer’s Report

Page 10

AddiƟonally, Assembly Bill 1572, which was passed by the State Assembly on
October 13, 2023, and relates to water use on lawns within the district, requires
that no irrigaƟon be used on nonfuncƟonal turf areas prior to January 1, 2028. The
district has two areas that are considered “nonfunc Ɵonal turf” by the bill that will
need to be removed and replaced, one along Bernal Avenue and the other just on
the other side of the entry wall on Tapestry Way. Depending on the level of
improvements, the turf conversion could cost a minimum of $25,000 to shut off
the water, mulch the area, and adjust irrigaƟon for the trees and up to $175,00 for
a complete landscape and irrigaƟon renovaƟon, and will require a loan or increase
to assessments in 2027 to cover the costs.
The landscape will conƟnue to decline below the necessary maintenance
standards of the district established by Ordinance 2458. This may place the district
at risk of fines or liƟgaƟon. To limit liability for the district, it will be necessary for
the city to conƟnue to pursue a permanent soluƟon, such as the HOA taking over
maintenance or a proposiƟon 218-compliant vote, incurring significant consultant
costs, unƟl a sustainable assessment has been agreed to by property owners.
If addiƟonal funding from a new or increased assessment is not implemented, the
City will be forced to conƟnue to reduce maintenance and postpone faciliƟes
upgrades, resulƟng in a conƟnuing deterioraƟon of the grounds and faciliƟes.
For 2025-26 costs/revenues, see Figure 3 – FY 2025-26 Actual Costs and Revenues.
Engineer’s Report and Continuation of Assessments
Each year for which the assessments will be conƟnued, the City Council must direct
the preparaƟon of an Engineer's Report, budgets and proposed assessments for
the upcoming fiscal year. AŌer the Engineer's Report is completed, the City Council
may preliminarily approve the Engineer's Report and proposed assessments, and
establish the date for a public hearing on the conƟnuaƟon of the assessments.
This Report was prepared pursuant to the direcƟon of the City Council.
