Item #5
CITY COUNCIL AGENDA REPORT

June 2, 2026
Public Works - Engineering Division

TITLE: ADOPT RESOLUTIONS PRELIMINARILY APPROVING THE ENGINEER’S
REPORTS FOR LANDSCAPE MAINTENANCE DISTRICTS 1984-1
(PONDEROSA-DEL PRADO), 1993-1 (WINDSOR), 1993-2 (BONDE RANCH),
1994-1 (OAK TREE FARM), AND 1995-1 (MOLLER RANCH), DECLARING THE
CITY’S INTENTION TO ASSESS THE PROPERTIES FOR THE COST TO
OPERATE AND MAINTAIN THE DISTRICTS; AND SETTING JULY 21, 2026, AT
7:00 P.M. AS THE DATE AND TIME FOR THE PUBLIC HEARING

SUMMARY
The annual Engineer’s Reports for the Landscape Maintenance Districts (LMDs) 1984-1
(Ponderosa-Del Prado), 1993-1 (Windsor), 1993-2 (Bonde Ranch), 1994-1 (Oak Tree Farm),
and 1995-1 (Moller Ranch) have been prepared for fiscal year (FY) 2026/27. These districts
were established to maintain the common landscaped and lighted areas within each
development in accordance with City-approved development plans.

Over time, maintenance levels within these LMDs were reduced to keep assessment rates flat.
As a result, current revenues are insufficient to maintain the improvements at their intended
service levels or to address necessary maintenance and infrastructure replacement needs.
Fund reserves have also been depleted due to rising maintenance and water costs, while
revenues remained unchanged from FY 1999/2000 until last fiscal year, when rates were
restored to levels consistent with those approved at district formation.

All district assessments will remain the same as last year. The Windsor LMD is in the worst
financial condition, but the City is working with the homeowners association (HOA) to take over
maintenance responsibilities to address the shortfall. The other districts, although significantly
improved by the restoration of the original assessment rates, will require further increases in
the future.

Under Proposition 218, any increase in assessments above the originally approved maximum
requires voter approval by those property owners in each district. The Ponderosa-Del Prado
and Bonde Ranch LMDs are undergoing a parallel Proposition 218 process. Accordingly, the
Engineer’s Reports for those two districts reflect the assessments that may be levied if the
Proposition 218 vote does not pass. The Moller Ranch and Oak Tree Farm LMDs were
approved with an inflation factor, but, based on a recent court case, Thacker vs. the City of
Fairfield, it is questionable whether those inflation factors can be used to raise assessments,
so this year the assessments will remain the same as last year and will continue that way
unless that court case is further litigated.

The Engineer’s Reports determine the annual assessments to be levied on property owners
within each district to cover the cost of administration, electricity, water, landscape
maintenance, irrigation, and infrastructure replacement.
