Page 8
The Oak Tree Farm Lighting and Landscape Maintenance District No. 1994-1
purpose is to fund the maintenance of the existing Oak Tree Farm subdivision open
space areas, entry features, decorative lighting, firebreaks, trees, shrubbery,
groundcover and irrigation systems.
District 1994-1 is funded by the benefit assessment approved in 1994
("Assessment"), and it does not receive any direct revenues from property taxes
or any other funding sources.
Based on research of the historical documents and in consultation with their
consultant, SCI Consulting Group, and an attorney that specializes in assessment
law, JarvisFay, the fiscal year 2025-26 assessments for District 1994-1 were
restored to the amount approved by the formation documents for the Oak Tree
Farm LMD, as recorded with Resolution 94-110, an amount of up to $1,000 with
an inflation escalator based on the Consumer Price Index for the year.
Under Proposition 218, a property owner vote is only required when these
assessments are increased, and an assessment is not increased if it is set at an
amount that is no more than the maximum amount initially authorized when the
assessment district was created. (Cal. Const. Art. XIII D, § 5(b); Gov. Code §
53750(h)(2)(B).) As a first step toward a more sustainable assessment level,
assessments were restored last year, as approved by Resolution 94-110 and
implemented with Resolution 98-076, to $617.41 per parcel per year. The
formation documents also authorize an annual escalator based on the Consumer
Price Index up to the $1,000 maximum; however, in light of the recent decision in
Thacker v. City of Fairfield, which has called into question the validity of applying
formation-era inflation escalators, the City has elected not to apply the CPI
escalator for fiscal year 2026-27. The assessment rate therefore remains at
$617.41 per parcel. With a total of 42 parcels in the District (including one public
parcel), fiscal year 2026-27 total assessment revenue will be $26,362.
The fiscal year 2026-27 assessment rate for District 1994-1 is $617.41 per parcel
per year (base rate), plus a County collection fee of$10.50 per private parcel, for
a total of$627.91 per private parcel. With a total of 42 parcels in the District, fiscal
year 2026-27 total assessment revenue will be $26,362.
City of Pleasanton ►
Lighting & Landscape Maintenance District No. 1994-1, SClConsuttingGroup
Oak Tree Farm
Engineer's Report
