P18-0078, P18-0080, P18-0081, PUD-130 and Tract 8569 (Hidden Canyon) Planning Commission
10 of 28
Zoning District
The project site is Pre-zoned-PUD-OS-A&G/OS-PH&S/LDR/HOZ (Planned Unit Development-
Open Space-Agriculture & Grazing/Open Space-Public Health and Safety/Low Density
Residential/Housing Opportunity Zone) Districts.
Pre-zoning establishes the framework for future development of the project site, including
areas designated for LDR uses. Development of single-family residences is permitted with the
LDR designation, subject to the standards and development plan established through the PUD
process. The proposed project is consistent with this pre-zoning framework.
The Oak Hills property at 10971 Dublin Canyon Road, is also included as part of the
annexation area but is developed with an existing religious facility. No changes to the land use
are proposed for this property, and it would continue to operate under existing conditions. Any
future modifications to the use or development of the Oak Hills site would be subject to
separate City review and approval.
INCLUSIONARY ZONING ORDINANCE (IZO) AND AFFORDABLE HOUSING
Pleasanton Municipal Code (PMC) Section 17.44.040(A) provides that for all new single-family
residential projects of 10 units or more, at least 15 percent of the project’s dwelling units (i.e.
six affordably priced units in the development) shall be affordable to very low, low-income,
and/or moderate-income households, with such units provided on-site. Section 17.44.080 of
the IZO allows for alternative compliance methods, recognizing that providing affordable units
on-site may not always be feasible.
While the current ordinance provides that the City Council approval of an alternative
compliance approach is required, at the time of the IZO update in 2022, projects deemed “in
process,” were allowed to be subject to the provisions of the prior ordinance. The proposed
project has been under review since 2018, including issuance of a CEQA Notice of Preparation
before passage of the IZO update, and qualifies under this provision.
As such, the prior IZO permitted payment of fees, rather than constructing on-site units, and
this is the approach selected by the applicant as they have asserted building the units on-site
would not be financially feasible.
Pursuant to the PMC, Affordable Housing funds paid to the City may be used for a wide range
of projects; including but not limited to, support for existing City housing programs that benefit
lower-income households, funding a future affordable housing project proposed by the City, or
to acquire land for construction of a project.
In accordance with PMC Section 17.44.060, an Affordable Housing Agreement with Ponderosa
Homes is not required because this project is permitted to pay the Affordable Housing Fee to
meet the IZO requirements, as reflected in the Pre-Annexation and Development Agreement.
PROJECT DESCRIPTION
The applicant proposes: 1) annexation (P18-0078) of five parcels totaling 130.98 acres; 2)
General Plan amendments (P18-0080) of four parcels to redesignate proposed residential
areas from Open Space–Public Health and Safety to Low Density Residential and proposed
open space areas from Low Density Residential to either Open Space –Public Health and
