P18-0078, P18-0080, P18-0081, PUD-130 and Tract 8569 (Hidden Canyon) Planning Commission
27 of 28
independent judgment of the City. In addition, CEQA Guidelines Section 15091 requires the
City to adopt findings for each significant environmental impact identified in the EIR.
The EIR evaluates the potential environmental impacts associated with construction and
operation of the proposed project. As documented in the EIR and summarized in the Findings
of Fact, the majority of environmental impacts would either be less than significant or reduced
to less than significant levels through the incorporation of mitigation measures identified in the
Mitigation Monitoring and Reporting Program (MMRP).
Impacts Reduced to Less Than Significant with Mitigation
The EIR identifies several environmental topic areas where impacts would be potentially
significant but can be reduced to a less than significant level through implementation of
mitigation measures. These include aesthetics (light and glare), biological resources, geology
and soils (including paleontological resources), and hazards and hazardous materials.
Applicable mitigation measures are identified in the MMRP included in Exhibit A and would be
implemented as part of project approval to ensure impacts are reduced to less than significant
levels. In addition, the EIR determined that impacts related to air quality, greenhouse gas
emissions, hydrology, noise, recreation, and utilities would be less than significant without
mitigation.
Significant and Unavoidable Impacts
The EIR identifies transportation-related vehicle miles traveled (VMT) impacts as significant
and unavoidable. While mitigation measures would reduce VMT, they would not achieve the
level of reduction necessary to meet applicable thresholds, and no additional feasible
mitigation measures or alternatives have been identified to further reduce these impacts. As
such, both project-level and cumulative VMT impacts remain significant and unavoidable,
which is typical for low-density residential development in areas with limited transit access.
Statement of Overriding Considerations
Because the EIR identifies significant and unavoidable impacts, approval of the project
requires adoption of a Statement of Overriding Considerations. As outlined in the Findings,
project benefits include development of a Housing Element site, preservation and dedication of
substantial open space, expansion of public access to regional recreational amenities, and
roadway and safety improvements. These benefits are determined to outweigh the project’s
unavoidable VMT impacts.
Based on the EIR, and with adoption of the CEQA Findings, MMRP, and Statement of
Overriding Considerations, the project has been analyzed in compliance with CEQA, and all
necessary findings for certification can be made.
SUMMARY/CONCLUSION
Staff worked closely with the applicant on the proposed development over an eight-year period
and appreciated the applicant’s cooperation in revising the proposal to address comments
from the Planning Commission Work Session and staff concerning site layout and other
elements of the project. The proposed development is well-designed, would preserve a large
amount of open space, provide a public amenity through the construction of a staging area,
and would be compatible with other residential developments in the immediate vicinity. Staff,
therefore, finds the annexation, General Plan amendments, rezoning, PUD development plan,
