DMA, Inc. 8 Application Attachment 3-10-26.docx

III. Suggested Operational Conditions:
Fusion agrees to adopt all the existing CUP conditions applicable to Suite 120 (Res. No. PC-2021-02).
The following additional measures are either already part of the project description or proposed to
ensure operations do not disrupt the quiet enjoyment of the adjacent and surrounding office land
uses:
1. Access/Traffic/Circulation/Parking:
a. Ensure that Fusion staff, caregivers, and HS students that drive are fully versed at the
start of each semester of all parking and access policies for safe ingress, egress,
parking, and pedestrian paths of travel.
b. Schedule open house or parent/teacher conferences during periods of reduced parking
demand.
2. Tenant and Office Park Compatibility:
a. Post an emergency contact telephone number on the entry and exit doors leading to the
Fusion tenant space.
b. Prohibit amplified sound inside the suite that can extend outside the suite perimeter.
c. Establish rules, regulations, and policies for required student behavior when outside the
suite in any common area or onsite.
d. Prohibit loitering outside the Fusion suite while students are waiting for caregiver
transportation to arrive.
e. Utilize a shared ride location (Uber/Lyft) consistent with what other tenants are using.
3. Livermore-Pleasanton Fire Department (“LPFD”)/Pleasanton Police Department:
a. Comply with fire life safety occupancy and code requirements as reasonably required
by the Building Department and Fire Marshal consistent with the low student/staff ratio
and uncomplicated ingress/egress applicable to a low-rise building.
b. Maintain the contact information for PPD at the reception desk.
4. Occupancy and Operations:
a. Limit occupancy on site at any time to 65 students and 33 staff.
b. Limit hours of operations M-F to 7:30 am to 8:00 pm year-round, with occasional
student appointments and administrative meetings outside these hours.
