DMA, Inc. 11 Application Attachment 3-10-26.docx

C. That the proposed conditional use will comply with each of the applicable provisions
of this chapter.
a. Compliance with CUP Process: The subject site’s zoning designation conditionally
permits private schools with more than 20 students through the issuance of a CUP (PMC
Table 18.44.080). Issuance of a CUP for the expanded use would be consistent with the
City’s ability to conditionally regulate zoning and land use (PMC Ch. 18.124).
b. Operations Have been Compliant: City staff have not received notice from tenants or
the property owner that Fusion’s use of suite 120 during the past eight years has been
impactful, nor has it necessitated consideration by staff to utilize the notice and cure
provision of the CUP conditions to have Fusion attend a Commission hearing for
consideration of additional conditions to mitigate alleged impacts.
c. Floorplan Expansion and Parking Implications: Expansion of the floorplan to increase
occupancy for additional one-to-one teaching space, administrative offices, and silent
study areas is not subject to minimums established by the CA DE for degree
matriculation or for maintaining WASC accreditation as a private school. Required and
provided parking is 41 spaces and is openly available proximate to both the east and
west sides of Lobby C subject building with safe and compliant pedestrian paths of
travel, and compliant location, number, and sizing of accessible parking spaces.
d. As such, the Commission concludes this finding can be made.

V. Visual Study
Sixteen exterior and interior photographs are provided in the Visual Study.
The Visual Study assists City staff with review of existing conditions of the existing suite 120 and
the proposed Suite 100 on the first floor.
