P25-0116. P25-0116, P25-0018, PUD-154 and Tract 8123 (Arroyo Lago) Planning Commission
20 of 22
facilitate the utilities configuration and grading plan reflected in the project plans. The draft
PADA assumes this easement will be secured prior to construction of the project. In discussion
with the applicant, they have indicated a preference for the PADA to include a further
“backstop” provision that would recognize their ability to abandon the City project and
annexation efforts should the easement not be granted. Staff do not support the addition of
this language, since it could infer City support, in the agreement, for the County project that the
City has previously opposed on numerous grounds.

PLANNED UNIT DEVELOPMENT CONSIDERATIONS
PMC Section 18.68.110 sets forth the purposes of the PUD District and considerations to be
addressed in reviewing a PUD development plan. These purposes and considerations are set
forth in the draft Resolution included as Exhibit B and include whether the plan is in
conformance with the City’s General Plan; is in the interest of public health, safety, and general
welfare; and whether the plan would be compatible with developed properties in the vicinity. As
described in Exhibit A and based on the information and analysis provided in this report, the
staff recommends that the Commission make the required findings to recommend approval of
the PUD development plan to the City Council.

ENVIRONMENTAL ASSESSMENT
An Addendum to the Project FEIR (SCH No.2023050339), certified by the Alameda County
Board of Supervisors on February 10, 2026, was prepared for the Project to be annexed and
developed within the City of Pleasanton in accordance with the CEQA Guidelines.

CEQA Guidelines Section 15164 (a) provides that the Lead Agency (here, the City) shall
prepare an Addendum to a previously certified Environmental Impact Report (EIR) if some
changes or additions are necessary but none of the conditions described in CEQA Guidelines
Section 15162 calling for preparation of a subsequent EIR have occurred (CEQA Guidelines §
15164(a)).

The Addendum addresses minor revisions to the proposed project associated with the
proposed annexation of the project site into the City, such as changes to the project grading,
and to reflect the proposed connection to City utilities. With the annexation, the City would
assume land-use jurisdiction over the proposed project and would rely on the County FEIR as
the primary environmental document, with the City serving as the Lead Agency once the
project was annexed into the city. Pursuant to CEQA Guidelines Section 15164, the
Addendum evaluated the proposed changes and documents the basis for the conclusion that
the proposed changes would not result in new significant environmental impacts or a
substantial increase in the severity of previously identified impacts, and further, that no new
information of substantial importance has occurred. Therefore, concluding that preparation of a
subsequent or supplemental EIR was not required. It is noted that Alternative 2 in the Project
FEIR reflected the annexation and development of the project within the City of Pleasanton
and was identified as the environmentally superior alternative in the FEIR.

The Addendum includes applicable mitigation measures identified and discussed in the County
FEIR, as well as related implementation measures to ensure compliance therewith, which
would be implemented by the proposed Project.

As required by Public Resources Code Section 21081.6 (a)(1), a Mitigation Monitoring and
Reporting Program (MMRP) has been prepared for the proposed project in order to monitor
