Resolution No. PC-2026-13
Page Three

Accordingly, the Planning Commission finds that the location is suitable for the
proposed private school to operate without adverse impacts on surrounding uses, is in
accordance with the objectives of the zoning ordinance, and the purpose of the
applicable zoning district and PUD. Accordingly, the Planning Commission makes this
finding.

B. That the proposed location of the conditional use and the conditions under which
it would be operated or maintained will not be detrimental to the public health,
safety, or welfare, or materially injurious to the properties or improvements in the
vicinity.

As conditioned, the Planning Commission finds the proposed private school will not
have a detrimental impact on the public health, safety, or welfare, or be materially
injurious to the properties or improvements in the vicinity. Private schools generally do
not subject surrounding uses to heavy truck traffic, hazardous odors, high noise levels,
or other objectionable influences. The use is entirely within a multi-tenant building and
would generate noise levels similar to those of the existing professional and medical
office uses. There will be adequate parking to accommodate the proposed use and the
existing uses in the building. All streets around the subject site are designed per City
standards to provide safe ingress and egress to and from the site. Furthermore, if the
operation of the business results in conflicts regarding parking, noise, traffic/circulation,
or other factors, a condition of approval allows the Planning Commission to determine
whether the proposal needs to return to the Planning Commission for further
consideration or additional mitigation measures. Accordingly, the Planning Commission
finds that the proposed use will foster a harmonious relationship among surrounding
land uses, will not result in harmful intrusions or adverse effects on the vicinity, and is in
the best interests of public health, safety, and general welfare. Accordingly, the
Planning Commission makes this finding.

C. That the proposed conditional use will comply with each of the applicable
provisions of the zoning ordinance.

The subject site's zoning conditionally permits a private school with more than 20
students through a CUP process. Granting a CUP for a private school with more than
20 students would be consistent with the City's authority to regulate zoning, as set forth
in Chapter 18.124 of the Municipal Code. In addition, the Planning Commission finds, as
conditioned, the proposed use will comply with all provisions and requirements of the
City’s zoning ordinance. Accordingly, the Planning Commission makes this finding.

Section 5: The Planning Commission hereby approves Case No. P26-0222, the application
Fusion Academy, on behalf of the property owner, Spieker Keech Hacienda, LLC, for CUP
approval to expand and operate an existing private school with a maximum of 65 students
