ARROYO LAGO RESIDENTIAL PROJECT
ADDENDUM

90 FCS
Https://adecinnovations.sharepoint.com/sites/PublicationsSite/Shared Documents/Publications/Client (PN-JN)/2148/21480036/Addendum/21480036 Arroyo Lago Residential Project Addendum.docx
f) Habitat Conservation Plan/Natural Community Conservation Plan
Would the project: Conflict with the provisions of an adopted Habitat Conservation
Plan, Natural Community Conservation Plan, or other approved
local, regional, or State Habitat Conservation Plan?
Prior FEIR Conclusions
The Prior FEIR determined that the project site is located within the boundaries of the East Alameda
County Conservation Strategy (EACCS).26 The EACCS is a framework for guidance by regulatory
agencies and does not include incidental take permits for threatened or endangered species, similar
to those provided by a Habitat Conservation Plan. In addition to the mitigation measures outlined
above, the Prior FEIR recommended that the County Project adhere to general avoidance and
minimization measures identified in the EACCS with some modifications to reflect project-specific
circumstances. Implementation of the avoidance measures and MM BIO-1a and MM BIO-1b, as well
as MM BIO-2a and MM BIO-2b if Design Option B is selected, would mitigate all potentially significant
biological impacts to a less than significant level and ensure that the County Project would ensure
there is no conflict with the EACCS. Therefore, the Prior FEIR concluded that impacts would be less
than significant with mitigation incorporated. (Draft EIR, pp. 3.3-37, 6-13).
Proposed Project Analysis and Conclusion
Similar to the County Project, the proposed project would be required to implement MM BIO-1a and
MM BIO-1b, as well as MM BIO-2a and MM BIO-2b. The proposed project would also be required to
adhere to the general avoidance and minimization measures identified in the EACCS, such as
EACCS Measure GEN-05, which requires that vehicles and equipment be parked on pavement,
existing roads, and previously disturbed areas to the extent practicable. Implementation of applicable
avoidance and minimization measures, and MM BIO-1a, MM BIO-1b, MM BIO-2a, and MM BIO-2b,
would mitigate all potentially significant biological impacts to a less than significant level and ensure
that the proposed project would not be in conflict with the EACCS, consistent with the impact
conclusions set forth in the Prior FEIR. Therefore, the proposed project would not introduce new
significant impacts or create substantially more severe significant impacts than those previously
identified in the Prior FEIR. No additional analysis is required.
Zone 7 Stormwater Option
The Zone 7 Stormwater Option would not result in any new or more severe impacts to biological
resources compared to those previously analyzed since it was considered in the Prior FEIR. Under
this option, ground disturbance would be reduced as compared to the City Stormwater Option
because the detention basin, pump facilities, and storm drain force main would not be constructed.
Accordingly, potential impacts associated with ground disturbance would be incrementally reduced.
Treated stormwater would continue to be managed through the proposed bioretention facilities and
would be discharged to naturally drain toward Cope Lake, subject to Zone 7’s approval. This option

26 Although the project site is not within the boundaries of a Habitat Conservation Plan, the EACCS was treated as one for
the purposes of this analysis.
