ARROYO LAGO RESIDENTIAL PROJECT
ADDENDUM

96 FCS
Https://adecinnovations.sharepoint.com/sites/PublicationsSite/Shared Documents/Publications/Client (PN-JN)/2148/21480036/Addendum/21480036 Arroyo Lago Residential Project Addendum.docx
still apply. However, because the proposed project would reduce the overall scope and nature of off-
site improvements compared to the County Project, the area where archaeological resources could
be affected would be reduced compared to the County Project. While mitigation for inadvertent
discovery would still be required, the overall potential for impact would be lower than the County
Project although the impact conclusion (less than significant with mitigation) would be the same. As
such, the proposed project would require the implementation of MM CUL-2a and MM CUL-2b to
reduce potential impacts to archaeological resources that may be discovered during project
construction. Fulfillment of these mitigation measures would likewise comply with Program 5.3 of the
City’s General Plan Conservation and Open Space Element, which requires imposition of a COA to
require cessation of all construction and grading activities within the vicinity of any discovered
prehistoric or historic artifacts, or other indications of cultural resources, until any such find is
evaluated by a qualified professional Archaeologist, and appropriate mitigation is approved by the
City. With the implementation of MM CUL-2a and MM CUL-2b, impacts related to archaeological
resources would be less than significant, consistent with the impact conclusions of the Prior FEIR.
Therefore, the proposed project would not introduce new significant impacts or create substantially
more severe significant impacts than those previously identified in the Prior FEIR. No additional
analysis is required.
c) Human Remains
Would the project: Disturb any human remains, including those interred outside of
formal cemeteries?
Prior FEIR Conclusions
The Prior FEIR acknowledged that, while no formal cemeteries or areas containing human remains
are known to be in the project vicinity, the possibility always exists that construction-related ground
disturbance may uncover previously undiscovered human remains. In the unlikely event such a
discovery is made, CEQA Guidelines Section 15064.5, Health and Safety Code Section 7050.5, and
Public Resources Code Sections 5097.94 and Section 5097.98 must be followed. MM CUL-3 outlines
procedures in accordance with Public Resources Code Section 5097.98, including contacting the
County Coroner and, if remains are determined to be Native American, notifying the NAHC. The Most
Likely Descendant (MLD) would be consulted regarding appropriate treatment pursuant to the
identified mitigation and applicable State law. Therefore, the Prior FEIR concluded that impacts would
be less than significant with mitigation incorporated. (Draft EIR, pp. 3.4-26, 6-14).
Proposed Project Analysis and Conclusion
Similar to the analysis of the County Project, no formal cemeteries or areas containing human
remains are known to be in the project vicinity. However, CEQA Guidelines Section 15064.5, Health
and Safety Code Section 7050.5, and Public Resources Code Sections 5097.94 and 5097.98 would
still be followed under the proposed project. In addition to compliance with applicable laws and
regulations, implementation of MM CUL-3 would still be required and would reduce potential impacts
to previously undiscovered human remains to a less than significant level, consistent with the impact
conclusion in the Prior FEIR. Therefore, the proposed project would not introduce new significant
