ATTACHMENT 1: PROPOSED REVISIONS TO THE PADA
[Note to City: Proposed revisions are shown in bold/underline text.]
*********************************************************
Section 3.2 Developer Obligations. Developer shall comply with all of the requirements
set forth below:
a. Subject to subsection (b) below, design and complete grading for the Project in a
manner that minimizes the grade differential between the Project’s westerly lots and the
abutting easterly lots within the Village at Ironwood subdivision; to satisfy this obligation,
Developer shall perform the foregoing work in substantial conformance with the approved
plans dated February 2026 (collectively, the “Approved Plans”) and as otherwise set forth
in the Project Approvals and Subsequent Approvals.
b. Provided, however, in the event that Zone 7 does not grant the utility easement
envisioned by and incorporated in the Project Approvals by January 31, 2027,
Developer and City acknowledge that Project design changes to accommodate utility
and/or grading modifications (in order to proceed without the Zone 7 utility easement)
will be necessary. If a substantial compliance finding under Government Code
section 66474.1 cannot be made with respect to the Vesting Tentative Map as it relates
to any such design changes, the Parties acknowledge that the Vesting Tentative Map
will need to be amended. Under such circumstances, the Parties shall work
collaboratively in good faith to expeditiously process and consider any such map
amendment to effectuate the Project, as modified by such Subsequent Approval.
Notwithstanding the foregoing, Developer agrees that any such design changes to the
Vesting Tentative Map shall show the grade differential between the Project’s westerly
lots and the abutting easterly lots within the Village at Ironwood subdivision to be no
more than one (1) foot difference as compared to the February 2026 Approved Plans.
