156 DIABLO ROAD, SUITE 340 | DANVILLE, CA 94526
Page 2

➢ Agreed to construct the utility and trail easement extension from Arroyo Lago to Mohr
($1MM)
Moreover, these significant concessions must be viewed in light of the fact that there is no legal
nexus between the project and the Future El Charro Road Extension in the first instance. As detailed
in the attached legal analysis (Attachment 1) that was presented to the City in October 2025 prior to
the City Council meeting (Attachment 1), given the lack of legal basis for the City’s funding demand,
the applicant’s willingness to pay the City $3,000,000 towards these regional improvements is
entirely voluntary and should be treated as such.
When the above items are taken into consideration the $3 million voluntary contribution to El Charro
Road is generous, which is why the City Council voted unanimously to approve the major terms of
the PADA back in October 2025. Since then there has been no new information or any change in
circumstances, which is why we are requesting the City Council honor the terms that were agreed
to in October.
We look forward to working with the City of Pleasanton to bring this signature project to fruition.
We welcome the opportunity to address any questions or feedback in advance of the Tuesday
evening hearing to help ensure alignment and a productive discussion.

Sincerely,

Cc: Steve Dunn, USL Pleasanton Lakes L.P.
Bridget Metz, USL Pleasanton Lakes L.P.
Joe Calabrigo, City of Pleasanton
Ellen Clark, City of Pleasanton
Katherine Wisinski, City of Pleasanton
Nadia Costa, GVR Partners

Stephen Reilly
330 Land Company LLC
