The side letter
establishes updated language regarding Hazardous Materials (Hazmat) Response Team
staffing and assignments, compensation, and the withdrawal process.

BACKGROUND
IAFF Local 1974 represents employees assigned to the Livermore-Pleasanton Fire
Department (LPFD) JPA. The JPA and IAFF Local 1974 are parties to a Memorandum of
Understanding (MOU) that establishes wages, hours, and other terms and conditions of
employment for represented employees.

During negotiations, the parties identified opportunities to address staffing within the Hazmat
program, agreed to establish a joint working group to explore potential solutions, and
established a temporary provision addressing Haz Mat program staffing, which expired on
June 30, 2026. Prior to the expiration of that provision, the parties met and conferred in good
faith in accordance with the Meyers-Milias-Brown Act regarding proposed modifications to
existing MOU language related to the Hazardous Materials Response Team. The resulting
Side Letter of Agreement #1 is intended to supersede any previous oral or written agreements
regarding the matters addressed in the side letter. Except as provided in the side letter, all
other terms and conditions of employment in the existing MOU remain unchanged.

DISCUSSION
In accordance with the Meyers-Milias-Brown Act, the parties are required to meet and confer in
good faith over items covered within the scope of representation, including wages, hours, and
other terms and conditions of employment.

The proposed side letter updates the MOU’s hazardous materials provisions to support the
Department’s ability to maintain adequate staffing for hazardous materials response above the
first responder level. The side letter maintains the Hazardous Materials Response Team
“Company” concept at the designated hazmat station and establishes a process for Hazmat
Certified Qualified members to support staffing needs, including movement to the designated
Page 243 of 344
