hazmat station as needed and in accordance with Department procedures.

The side letter does not change compensation for employees assigned to the Hazardous
Materials Response Team, who will continue to receive the existing incentive pay consistent
with the MOU. It adds incentive compensation for Hazmat Certified Qualified employees in
recognition of the additional training, qualifications, and assignment flexibility required to
support the program. Effective July 1, 2026, HMCQ members shall be compensated one-half
percent (1.5%) certification pay, increasing to 2% in 2027, and to a total of 2.5% in 2028.

The side letter also addresses participation in the hazmat program, annual training
requirements, and Department support for required hazmat technician-specialist certification
training. Except as modified by the side letter, all other terms and conditions of the existing
MOU remain unchanged.

Approval of the side letter will help encourage employees to obtain and maintain hazmat
qualifications and remain available for assignment to the designated hazmat station when
needed, supporting the Department’s ability to provide hazardous materials response services.

OUTREACH
This City Council agenda item provides the public with an opportunity to provide input and
comments on the key elements of the tentative agreement discussed herein.

FISCAL IMPACT
Based on staff's analysis, the estimated fiscal impact for the City is expected to be up to
approximately $72,000 in the current fiscal year, rising to almost $100,000 in FY 2027/28, and
just over $126,000 in FY 2028/29. These estimates assume maximum participation of 36 Full-
Time Equivalents (FTEs). Staff will present necessary budget adjustments as part of the mid-
year budget update process in early 2027.

RECOMMENDATION
Authorize the City Manager to sign the proposed side letter of agreement #1 amending the
hazardous materials elements of the Memorandum of Understanding between the Livermore-
Pleasanton Fire Department Joint Powers Authority and the International Association of
Firefighters, Local 1974 with term ending June 30, 2029

Prepared by: Submitted by: Approved by:

Ella Tabares, Management
Analyst
Xaviera Scoggins, Director of Human
Resources & Labor Relations

Joe Calabrigo, Interim
City Manager

Attachments:
1.
