City of Pleasanton—Additional Housing Sites Rezonings Project
Addendum CEQA Guidelines Section 15164 Addendum

54
Therefore, the proposed sites are within the Planning Area evaluated in the
Prior FEIR and would not alter the Prior FEIR’s conclusion, and implementation
of IM BIO-1 would ensure that any impacts to special-status species within
any riparian corridor or nursery site are avoided or minimized. Additionally,
because the proposed sites are already developed, future development on
these sites would not increase identified impacts. Therefore, impacts would
be less than significant, and the proposed project would not result in a new
or more severe adverse impact that was not previously identified and
disclosed in the Prior FEIR. No further analysis is required.
e) Local Biological Resources Policies/Ordinances Consistency
Would the project: Conflict with any local policies or ordinances protecting biological
resources, such as a tree preservation policy or ordinance?
Summary of Prior FEIR
The Prior FEIR identified the City’s Tree Preservation Ordinance as part of the
regulatory context for biological resources, and it separately evaluated
removal of mature trees in Table S-2 under BIO-11. The Prior FEIR also noted
new and revised General Plan programs intended to preserve natural habitat
areas, provide additional wildlife habitat areas, encourage heritage tree
preservation, promote no net loss of trees, and protect biological resources
more broadly.
The Prior FEIR’s findings show that the General Plan was structured with
conservation, open space, water, and tree-preservation measures intended
to avoid such conflicts. In that context, the Prior FEIR concluded that impacts
would be less than significant.
Proposed Project Analysis and Conclusion
The proposed sites are entirely within the Planning Area and urban
landscape evaluated in the Prior FEIR. The proposed sites may result in the
removal of additional trees protected under the City’s Municipal Code.
However, the proposed sites would be required to adhere to applicable
regulations related to tree protection, such as the City’s Municipal Code
Chapter 17.16, which requires a permit from the Community Development
Director for any Heritage Tree removal. With adherence to these applicable
regulations, impacts would be reduced to less than significant. The proposed
project would not result in a new or more severe adverse impact that was
not previously identified or disclosed in the Prior FEIR. No further analysis is
required.
