Ordinance No. 2308
1 . Sustainability Program 2.6 ("Require design features in new development
and redevelopment areas to encourage transit, bicycle, and pedestrian
access, such as connections between activity centers and residential areas,
and road design that accommodates transit vehicles, where feasible") in
that it will include a Class 1 trail extension between the Project site and
Mohr Avenue to facilitate transit, bicycle, and pedestrian access.
2. Land Use Policy 25 ("Annex urbanized pockets of unincorporated
land adjacent to the city limits in areas where landowners are willing to
accept City services and development standards") as it will annex a portion
of unincorporated land immediately adjacent to city limits where the
applicant is willing to accept City services and comply with City development
standards, as reflected in the requested PUD for the Project.
3. Land Use Policy 23 ("Maintain a permanent Urban Growth Boundary [UGB]
beyond which urban development shall not be permitted") as the Project
site is within the City's UGB.
B. The findings for denial of a tentative map set forth in Government Code §
66474 cannot be made with respect to the proposed tentative map.
The proposed tentative map for Tract 8423 is not inconsistent with the General
Plan, as set forth in finding 4(A) above, and no Specific Plan applies to it. Moreover,
the design or improvement of the proposed subdivision is not inconsistent with
applicable general and specific plans, as set forth in finding 4(A) above. The
Project site is not physically unsuitable for the type of development proposed, as
analyzed in the Addendum prepared for the Project. The Project site is likewise not
physically unsuitable for the proposed density of development (6.3 dwelling units
per acre), as the proposed General Plan land use designation allows development
of 2-8 dwelling units per acre. As analyzed in the EIR and the subsequent
Addendum, the design of the subdivision and the proposed improvements are not
likely to cause substantial environmental damage or substantially and avoidably
injure fish or wildlife or their habitat. Similarly, the design of the subdivision and
type of improvements (single-family homes) are not likely to cause serious public
health problems. Finally, the design of the proposed subdivision and the type of
improvements will not conflict with easements, acquired by the public at large, for
access through or use of, property within the proposed subdivision, as no such
easements are located on the Project site.
C. The discharge of waste from the proposed subdivision into an existing
community sewer system would not result in violation of existing
requirements prescribed by a California regional water quality control board
pursuant to Division 7 (commencing with Section 13000) of the Water Code.
