otherwise provided in the TSA, the Operator shall go to the bottom of the rotation tow list and
advance up the list until again called for service by the PPD.
B. Nothing shall prohibit a Police Supervisor or Officer from requesting a specific tow company
when, in the Police Supervisor or Officer's opinion, the Operator at the top of the rotation tow
list cannot clear a hazard as expeditiously as necessary.
1) In such an instance, after the Operator selected provides service to the PPD, the Operator
would then go to the bottom of the rotation tow list. Operators on the tow list that were
bypassed would remain in the same order until selected for a rotation for which they are
qualified.
C. Nothing shall prohibit a Class B, C, or D Operator from maintaining a place on a lighter class
rotation tow list, provided the tow truck meets the equipment specifications for that class of
operation.
D. One telephone call to an Operator shall constitute one turn on the rotation tow list and then the
Operator shall be moved to the bottom of the tow list. A turn on the rotation tow list includes
instances when the Operator fails to answer the telephone, is unable to respond, is unable to
perform the required service, refuses to respond or otherwise provide service, or is canceled
by the PPD due to excessive response time as determined by the Police Supervisor or Officer.
If the Police Supervisor or Officer determines that the Operator is not needed and is canceled
by the Police Department, up to and including arrival at the scene and standby time which
does not result in a tow, there shall be no charges and the Operator shall be placed back on
the top of the tow list.
1) If the Operator is canceled by the vehicle's registered owner or agent prior to the Operator
taking possession of the vehicle, there shall be no charges for towing. The Operator shall
immediately contact the PPD and advise it of the cancelation. The Operator shall then be
placed back on top of the tow list.
i. Possession is deemed to arise when the vehicle is removed and is in transit, or
when the vehicle recovery operations or load salvage operations have begun
(Civil Code (CC) §3068.1(a) and Vehicle Code (CVC) §22851 [a][1 ]).
ii. Whenever a vehicle's owner returns to a vehicle that is in possession of an
Operator prior to the removal of the vehicle, the owner may regain possession
of the vehicle from the Operator if the owner pays the Operator the towing
charges (CVC §22851 [a][2]).
2) If service other than towing, recovery, and load salvage has begun by the Operator and the
service is canceled by the vehicle's registered owner or agent, the Operator may charge
the vehicle's registered owner one-half the regular hourly service charges for the time
expended on the call. For purposes of cancellation, service begins when physical work on
the vehicle has begun, not the response. No charge or lien shall arise for the service
unless the Operator has presented a written statement to the vehicle's registered owner or
agent for the signed authorization for the services to be performed. Operator shall not
attempt to take possession of the vehicle in order to establish a lien for any non -towing
services performed, or initiated and subsequently canceled, when not entitled to such a
lien by law.
