CONTRACT DESIGNATING THE CITY OF PLEASANTON AS A SUB-RECIPIENT OF HOME FUNDS <br />This AGREEMENT is made and entered into this ~r-~ _ day of Ix4.c- :54--2005, by and <br />between the CITY OF PLEASANTON, hereinafter called "City," and ~eICOUNTY OF <br /> <br />ALAMEDA, hereafter called "County." <br /> <br /> WITNESSETH: <br />WHEREAS the City and County have entered into a Cooperative Agn ment to form the <br />Alameda County HOME Consortium to qualify for HOME Investment PR nership ACt funds, <br />funded by the U.S. Department of Housing and Urban Development; and <br /> WHEREAS the County is the lead agency in the Consortium, designated by ] IUD as the HOME <br /> Participating Jurisdiction; and <br /> WHEREAS the City and the County have determined that it is mutuall beneficial to have <br /> County disburse HOME funds for HOME-eligible activities in City; and <br /> WHEREAS the City must be designated a HOME Sub-recipient in or& to directly execute <br /> contracts for HOME-funded activities; <br /> NOW, THEREFORE, 1T IS MUTUALLY AGREED AS FOLLOWS: <br /> 1. Upon execution of this A4~reement, City shall be designated as a HO~ tE Sub-recipient for <br /> ible activities in the <br /> 2005 fiscal year funds for the purpose of administering HOME-dig <br /> City, the funds for which shall be disbursed by the County. The x ~aximum amount of <br /> fiscal year 2005 HOME funds covered by this agreement shall be $1 t8,566. In the event <br /> that the HOME allocation to the Consortium is reduced by HUD, the City's allocation will <br /> be reduced propottionately. <br /> <br /> 2. As a sub-recipient, City may contract with other entities to per brm HOME-eligible <br /> activities. HOME eligible activities City desires to engage in must b{ approved by County <br /> in advance of any contract being executed. County approval will be evidenced by a project <br /> approval letter to the City. <br /> .... hi, Agreement shall be <br /> 3. City agrees that any HOME-eligible activities funded through t , <br /> confirmed with a written contract that contains the provisions spec ified in 24 CFR Part <br /> 92.504. In addition, any contract made between City and anothe! entity for the use of <br /> HOME funds pursuant to this Agreement shall comply with z!l applicable HOME <br /> regulations and shall be enforced by deed restriction. The form o: the contract shall be <br /> approved by County in advance of its execution. A copy of all contracts for HOME- <br /> funded activities shall be sent to the County. <br /> 4.
