Home Owners Association and a number of surrounding property owners requesting a Zoning
Administrator hearing.

V. PUBLIC CORRESPONDENCE

At the time this staff report was written, 25 comments were received pertaining to this large
family daycare application (Attachment No.4, Exhibit C). The correspondences were in forms
of phone conversations, e-mails, and a report. Staff interacted with the concerned parties and
attempted to negotiate remedies to the issues that were raised. However, staff was unable to
alleviate the concerns about the facility use, parking, and traffic impacts.

Twenty-four (24) statements are from adjacent neighbors to the site, owners/residents within the
development, or residents within close proximity to the development.

The concerns ranged from the parking and traffic impacts, safety as a result of speeding,
increased traffic, as well as noise. All concerned parties expressed objection to the request for
an expanded facility at this location and request that the Planning Commission deny the
application.

A report was assembled by the Valencia neighborhood to explain and demonstrate their
opposition to the project. The report is attached to this report as part of the public
correspondences.

One (I) correspondence was received in support ofthe application, which noted the need for
such childcare facilities to be located within neighborhoods and explained the reality of the
traffic and parking situation.

VI. FINDINGS

The Planning Commission needs to make the following use permit findings prior to approving a
large family daycare home. These findings must relate to the specific proposal being made.

1. The location of the proposed conditional use is in accordance with the objectives of the
zoning ordinance and the purpose of the district in which the site is located.

- The subject site is in a PUD- HDR (Planned Unit Development- High Density
Residential) zoning district. Chapter 18.68 of the Pleasanton Municipal Code (PUD
Planned Unit Development District) states that planned unit development zoning
districts are created to encourage imagination and housing variety (size and design) to
provide areas for high density residential use and to be consistent with sound standards
of public health and safety. The State legislature declares that large family daycare
homes should meet other requirements specifically designed to promote the fire and life
safety of the children.

Case No. PDUP-8

Planning Commission

Page 6
