The applicant is required by the California Health and Safety Code, Section 1597.531 to provide
insurance in the amount of$100,000 (per occupant) for injury to clients and guests and either
insurance or a bond in the amount of$300,OOO (total annual aggregate) for negligence on behalf
of the licensee or its employees (Attachment No.5). The insurance would hold the HOA
harmless should the children be injured while in the common area. The State Department of
Social Services-CCL also requires this insurance to be in place prior to operation (Attachment
No.6). The applicant has stated that the required insurance has been obtained.

Land Use: The State of California Planning, Zoning and Development Laws mandates that
large family daycare homes shall be considered as a single-family residence with respect to
occupancy requirements. Though the subject property is located in a high-density development,
which allows the city more discretionary power, it is important to acknowledge the intent of the
State regulations for child daycare facilities is to limit the amount of regulation that is imposed
on the establishment and the intension for them to be located in residential neighborhoods.

The Pleasanton/Livermore Fire Department, Child Care links, and the Alameda County Child
Care Licensing Department have not identified this project to have pre-existing conflicts with
their regulations or standards for the existing small family daycare. Therefore, staff finds that a
large family daycare home meets the standards and regulations, which allows it to be located in
the proposed single-family, detached, residential development.

The City continues to review applications for large family daycares in high-density zoned
districts on a case-by-case basis. Staff does not feel that this recommendation is setting a
precedent for future large family daycare establishments in high-density developments, as there
are situations where conditions of approval would not be able to mitigate impacts.

IV. PUBLIC NOTICE

Notices regarding the appeal of the proposed conditional use permit for a large family daycare
were mailed to the property owners and tenants within 1,000 feet of the subject property.

Staff referred the proposed project to other agencies to ensure proper review of this request was
being done. The Livermore/Pleasanton Fire Department provided one comment pertaining to
speed bumps, of which they were not in favor of such traffic calming devices.

The proposal was also referred to Child Care Links and the Alameda County Child Care
Licensing Department. Child Care Links is an agency established to aid childcare facilities to
meet the state regulations for operation. No negative comments were received from either ofthe
agencies.

As required by the State and the Pleasanton Municipal Code, notices concerning the proposed
expansion were sent to the surrounding neighbors. As a result, staff was contacted by Valencia

Case No. PDUP-8

Planning Commission

Page 5
