LIVERMORE-PLEASANTON FIRE DEPARTMENT

M.O.U. APPENDIX "A"

Effective 8/1/98

1. The parties have agreed to use the services of City of Pleasanton for the administration of the LPFD
benefits programs.

2. The parties have agreed to use the current Flexible Spending Account system as provided and
administered by the City of Pleasanton. The employees covered by the City of Livermore FSA plan
will merge into Pleasanton's or continue in Livermore's until the end of the next plan year for
Livermore.

3. As the merger of payrolls into Pleasanton is for the convenience of both parties, the moved
Livermore employees are not to be considered "new hires" by the City of Pleasanton. As such:

a. Pleasanton will not require Medicare payments from pre-1986 hired Livermore employees.

b. All Livermore employees will continue their current seniority status, vacation and sick leave
accruals and balances.

4. In the event that currently unanticipated impacts of this merger in areas such as payroll
implementation are identified during the term of this contract, the union and the JPA agree to meet
and confer about such impacts.

36
