In response to this concern by HCD, the City Council has acted to retain its
existing High Density Residential range as requested.

b. Land Use Program 6.4 is intended to "generally" discourage the redesignation of
commercial, office, and industrial land to residential use. This issue is discussed
in Appendix E of the Supplement. The City has concluded that for reasons
relating to land use compatibility and safety, this program will not create a
governmental constraint to housing.

c. HCD has expressed opposition to proposed Land Use Program 19.2, which
requires a "super majority" City Council vote on certain General Plan
amendments relating to residential and non-residential growth. This program has
been eliminated by the City Council as requested.

d. HCD has expressed a concern that the City's Affordable Housing Fee will add
to the cost of housing for all income levels. However, the City's analysis in
Appendix E of the Supplement indicates that this fee is relatively minor and yet
has been essential to the City's provision of affordable housing for nearly
twenty (20) years. The elimination of this fee would substantially reduce the
City's ability to provide much needed affordable housing.

HCD has indicated that it does not support the City's adoption of inclusionary
requirements (Program 9.5). It further notes that such requirements would add
to the cost of housing for all income levels, and such additional costs could
constrain the development of market-rate units on which the inclusionary units
depend. The City feels that the State's position in this regard creates a major
impediment to the development of affordable housing. Although the City strongly
feels that the benefits of gaining the additional affordable housing would far
outweigh the potential increase of market-rate unit costs, the City Council has
deleted Program 9.5 as requested.

The following information has been generated and added to Appendix E of the
updated Supplement as requested by HCD:

· An analysis of the City's building codes and their enforcement;

· An analysis of Pleasanton's on-and off-site improvement
requirements;

· An itemization and discussion of developer, planning, and building
fees; and

· An outline and analysis of Pleasanton's procedures for processing
development applications.
