Resolution No. 93-139
Page Three

6. Although Council will make the final determination in which
year or years these units will be reallocated, Council will
give deference to a developeres initial reallocation request
and will attempt to accommodate such request.

7. Project developers participating in the Modified Growth
Management Program shall have priority in yearly allocations
over all other developers. Units in projects which are
reallocations of units originally approved for construction in
calendar year 1993 or earlier shall not count toward the
General Plan maximum, but the City Council may consider these
units in deciding whether to approve new projects. Units in
projects which are new approvals (approved for 1994 and later
years) shall count toward the yearly maximumwhich the Council
establishes for that year, and reallocations of these units
shall be accommodated within the General Plan maximum as
established by City Council. City Council may shift units to
a later year(s) than that requested if it finds it necessary
to do so in order to meet General Plan policies.

8. After this initial reallocation, participating developers will
use their best efforts to project actual building starts, on
~ Con~nuinu basis, so the Council can gauge actual
construction when considering new approvals. In other words,
all developers must keep the City informed of their progress
and must apply to reallocate units if building permits for
those units are not obtained (or the public improvements for
custom lots are not completed) in the year so allocated. If
a developer fails to apply for reallocation and building
permits are not obtained in .the year in question (or the
public improvements not completed for custom lots), the
developer cannot obtain a building permit until the developer
has reapplied for growth management (under the Modified
Program) and has been granted a new year in which to obtain
such permit.

9. Participating developers agree not to build units at a rate
faster than their annual allocation, and they must semi-
annually (in February and August) modify, if necessary, their
projections to reflect their then-existing best estimate of
actual construction. Modifications of projected build-out are
unlimited for participating developers, but the year(s) when
construction will be permitted will be determined by Council.
'Applications must be received by June 30 (for August) and
December 31 (for February).
