Resolution No. 93-139
Page Four

10. When semi-annual reviews are made, developers may move units
into later years or into earlier years from those originally
estimated, subject to Council approval. The intent is to
allow a developer who is ready to build to utilize the
allocated units of a developer who is moving units to later
years, thus coming closer to actual construction meeting the
total yearly allocation, as well as eliminating the backlog.

11. Participating developers agree to allow Council to extend the
requested time-frame for pulling building permits in years
when actual construction is projected to exceed the General
Plan maximum and/or if infrastructure is projected not to be
available for new development.

12. For production units or apartments, a building permit will be
issued only in the calendar year for which a unit has growth
management approval. No building permits will be allowed to
be pulled 6 months in advance of the calendar year of
allocation as allowed under the former growth management
ordinance.

13. If the Council must defer a developer~s proposed rescheduling
of units to a year later than that requested, that developer
shall have a preference in returning units to the originally
desired year (if desired) should units in that year become
available due to other developerse shifting units to later
years.

For example, assume that after the initial reallocation
the units look like this:.

1994 1995 1996 ~997 1998

700 650 500 450 400

Assume Developer X has 50 units for 1994, 30 in 1995, and
20 in 1996. In July 1994, X believes it will only be
able to pull 30 building permits for 1994. Consequently,
X must reallocate the remaining 20 units and thereby
requests reallocation for 1995. Because, however, 1995
already has 650 approved units, Council reallocates the
20 units to 1996.

Then in July 1995, Developer Y who had 50 units for 1995
asks to move 30 units to 1996. Council agrees, but now
an "opening" in 1995 has been created. Developer X would
be given a preference to move the 20 units (reallocated
from 1994 to 1996) to 1995.
