Draft Environmental Impact Report
Bernal Property Phase II Specific Plan

(2) [If the project would] have a substantial adverse effect on any riparian habitat or
other sensitive natural community identified in local or regional plans, policies,
regulations or by the CDFG or USFWS;

(3) [If the project would] have a substantial adverse effect on federally protected
wetlands as defined by Section 404 of the Clean Water Act (including, but not
limited to, marsh, vernal pool, coastal, etc.) through direct removal, filling, hydro-
logical interruption or other means:

(4) [If the project would] interfere substantially with the movement of any native
resident or migratory fish or wildlife species or with established native resident or
migratory wildlife corridors, or impede the use of native wildlife nursery sites;

(5) [If the project would] conflict with any local policies or ordinances protecting bio-
logical resources, such as a tree preservation policy or ordinance;

(6) [If the project would] substantially degrade the quality of the environment; sub-
stantially reduce the habitat of a fish or wildlife species; cause a fish or wildlife
population to drop below self-sustaining levels; threaten to eliminate a plant or
animal community; or substantially reduce the number or restrict the range of an
endangered, rare or threatened species,

Biological resources are regulated under a number of federal and state policies, the imple-
mentation of which is the responsibility of various federal and state agencies, These
agencies are identified and described in Appendix D,

c. Impacts

(1) Impacts on Riparian Habitat

Environmental Issues

The Arroyo is a biotic resource of regional significance, While the project does not propose
any construction or improvements within the channel of the Arroyo, development of trails
and other infrastructure could affect the riparian habitat within the corridor of the Arroyo if
the permitted development is located within the sensitive riparian habitat areas, The dry
channel east of the Arroyo and existing drainage channels tributary to the Arroyo (channel B-
2-1 is noted above) may also support riparian habitat.

Mitigation Measures Built Into the Specific Plan

Measures built into the Specific Plan would protect habitat vegetation and avoid possible
impacts on the Arroyo de la Laguna and other riparian habitat that might otherwise result
from the construction of trails and other infrastructure.

.

Consultation and Section 404 permit application would be required with the U,S,
Army Corps of Engineers prior to any activity within the banks of the Arroyo channel.
The Phase II Specific Plan does not call for encroachment into, or construction
within, the channel of the Arroyo de la Laguna,

64
