Chapter 4
Environmental Setting, Impacts, and Mitigation Measures
E, Cultural Resources

An exclusion zone of 250 feet shall be established around any active nests of any raptor
species found on the project site until all young have fledged,

. Pre-construction breeding surveys for special status songbirds shall be implemented
and an exclusion area be established around any active nests.

If project construction or tree removal is scheduled between March 1 and August 15, a
pre-construction survey for special status species songbirds shall be conducted and a
50-foot exclusion zone shall be established around any active nests of such species
found on the project site until all young have fledged, Consideration should be given
to similar management of active nests of other MBTA-protected bird species found on
the project site,

With the incorporation of these measures, impacts on raptors and nesting birds would be
reduced to a less-than-significant level.

d. Mitigation Measures

With the incorporation of the measures described into the Phase II Specific Plan, no signifi-
cant effects related to biological resources have been found; therefore, no mitigations are
needed,

1. Framework for Analysis

This section addresses the relationship between the proposed Phase II Bernal Property
Specific Plan and cultural resources of the site,

The Specific Plan site, and particularly its Western Area, is known to be an area of archaeo-
logical resources, The cultural setting (history, prehistory and ethnography) of the project
area is thoroughly described and evaluated in earlier CEQA documents,14 A comprehensive
summary of the cultural resources setting drawing on earlier cultural resources assessments
and evaluations is provided in Chapter 5, Part M of the 1997/2000 EIR, which is hereby
incorporated by reference,

2. Setting

The project area has been surveyed for the presence of archaeological sites or resources, in
whole or in part, on several occasions since the 1970s, Two significant archaeological sites
are known to be located in the Plan area: sites CA-Ala-483 and CA-Ala-SS4,

14 The most extensive presentation was prepared for the 1995 Bernal Property Annexation DEI R by William Self
Associates, Consultants in Archaeology and Historic Preservation. A description of site features and other
archaeological and historical information provided in that document are summarized in the 1997/2000 EIR.
Both documents are available for public review at the office of the Pleasanton Planning Department.

69
