A solution would be the extension of Valley Avenue to Stanley and what is
now Bernal A venue from the bridge to Stanley. The streets would meet at what
is now Stanley and Bernal.

In light of the pending shopping center approval, Frank and Konrad
signed the enclosed agreements, i.e. Valley A venue Extension Agreement, and
agreed to construct Bernal Avenue and contribute $317,441 and 42,936 sq. ft. of
land prior to the development of the shopping center.

The shopping center application was denied by the City Council. Frank
and Konrad constructed Bernal A venue to its present state and contributed the
money and the land.

The ongoing traffic problem once more raised its ugly head in 1999. We
were asked to contribute land for acceleration and deceleration lanes on the east
and west side of Bernal at the intersection. For twenty years the proposed
shopping center has been a part of our consideration in working with the City to
solve problems that we have not created.

At present it is our understanding that Regency is being asked once more
for further contributions to the traffic problem and to date no one has considered
all that Frank and Konrad have done in prior years. Road construction net
$900,000 land, not including the road, 52,367 sq. ft.

Frank and Konrad believe that after 20 years of mitigating Pleasanton's
traffic problems it is time that the "proposed" shopping center of 1985 come to
fruition and that traffic not be an excuse for denying approval.

Should questions arise as to the agreements above, we have sent the
documents to the City Manager with a similar letter.

Very truly yours,
,)

i.....

John P.
