The City and Property Owners entered into the Agr~mc1lt regarding the <br />commercial development ofPropeny Owners' approximately 30.05 acres of <br />property (the -Property"), and the immediate construction of the Bernal Avenue <br />extension through the Pi uperty . <br /> <br />B. Since the completion of me Bernal Avenue Extension as contemplated in the <br />Agreement, the traffic congestion at the intersection of Bernal Avenue and Stanley <br />Boulevard has significantly im:reased. <br /> <br />C. The Agreement had provided for the dedication and constrUCtion by the Property <br />Owners of a deceleration IllIlC at Stanley Boulevard along the frontage of their <br />property at Lot 8 and Lot 9 of Parcel Map 5814 in conjunction with the <br />development of the Property_ <br /> <br />D. The City desires to have the right-of-way for the deceleration lane dedicated at this <br />time to allow for immediate construction of the deceleration laDe, rather than <br />waiting for me dedication to occur in conjunction with development of the Property. <br /> <br />E. Furthennore. the City requires additional right-of-way along the Stanley Boulevard <br />frontage of the Remairvfer Parcel of Parcel Map 5814 in order to complete road- <br />Widening for improVed traffic circulation. <br /> <br />F.
