<br />NOW. THEREFORE. in exchange for valuable consideration. the receipt of which <br />is hereby acknowledged, the parties agree as follows: <br /> <br />1. Dedication of Rillht-Of-Wav. The Property Owners agree to dedicate to the City <br />the following: <br /> <br />3,838 +/- sq. ft. of property from Lot 8 of Parcel Map 5814 <br /> <br />3.079 +/- sq, ft. ofpropeny from Lot 9 of Parcel Map 5814 <br /> <br />2,614 +/- sq. ft. of property from the Remainder Parcel of Parcel Map 5814 <br /> <br />as shown m~ particularly on the attaChed EXhibit "A", ("Stanley Boulevard <br />Striping Plan, Option No.2, dated September 27, 1999) incorporated herein by <br />this reference. <br /> <br />When the City finllli~ documents and plans for the widening of Stanley Boulevard, <br />construction of the deceleration lane and sniping plan, and prepares the necessary <br />legal descriptions of the right-of-way to be dedicated, the City will provide the <br />Pruv.aly Owners thirty (30) days notice to execute and deliver the necessary grant <br />deeds for the right-of-way dedication.. <br /> <br />2. No Cost for Dedication. The right-of-way descnbed in Section 1, above, shall be <br />dedicated to the City by the Property Owners at no cost, <br /> <br />3. City to Pav for Street Widf'ltin~. 'The City will pay all costs related to the design <br />and consnuction of the deceleration lane. street widening. and re-striping as <br />described in EXhibit .. A". This amends Section 3.b,(1) of the Agreemem. <br /> <br />4. Stanlev Boulevard Access For Lot 8 and Lot 9. <br /> <br />A. Section 3.b.(3)(c) of the A~<;cwent shall be amended to permit access to Lot 8 <br />and Lot 9 from Stanley Boulevard at a single access point to be centered on the <br />lot line between Lot 8 and Lot 9. If the Property Owners desire a different <br />access point, it must be muma1Iy agreed upon by the parties. <br /> <br />B. The Property 0wDeri shall advise the City within thirty (30) days of the dale of <br />this Amendment whether the Property Owners desire a street opening to be <br />constructed in conjunction with tbe CIty' s road widen.in2 project. or if the <br />Property Owners desire the City to build the sidewalk and planter strip across <br />the entire length of Lot 8 and Lot 9 along Stanley Boulevard.
