THE CITY Of
~' I ~
m~~~~ - . .
w~ a .... _~_~i
j~L~~S~4NTONo
MEMORANDUM
Date: January 10, 2007
To: Planning Commission
From: Planning Department Staff
Subject: PUD-56, Aminian
Since the staff report was drafted, staff has received comments from two neighbors on Gray Fox Circle,
a neighbor on Ingrid Court, and from the applicant (see below).
Comments from Neighbors on Gray Fox Circle
Two neighbors on Gray Fox Circle indicated that they did not receive a hearing notice in the mail. Per
City records, meeting notices were mailed to them and everyone on Gray Fox Circle and Foxbrough
Place on December 31, 2006. The three most impacted neighbors on Gray Fox Circle were aware of the
tentative meeting date and were mailed copies of the staff report.
Comments from Neighbor on Ingrid Court (by Clara Lane)
A resident on Ingrid Court expressed a concern about construction traffic on Clara Lane. He expressed
an initial concern about the hours of construction and damage from trucks on private pruperty. After
discussing the issue with staff, he seemed okay with staff's standard construction hour condition
(condition #55), and with staff's standard collection of ahazard/erosion bond which can be used to
cover damage to private property.
The resident would like to modify the Hatsushi property PUD such that no construction traffic for the
Hatsushi development is allowed on Clara Lane. However, only the property owners (i.e., the
Hatsushis) can apply to modify their PUD approval. The Hatsushi PUD was approved in June 2006.
The Tentative Map has not yet been approved.
Comments from Applicant
The house on Lot 1 is proposed to be 28.4 feet in height. The applicant is not willing to grade down this
lot by five feet and build a five foot tall retaining wall behind his house as recommended by staff.
However, he is willing to grade down two feet, install a two foot tall retaining wall, and lower the roof
of the house by 1.5 feet, thus making the house appear to be approximately 25 feet in height as viewed
from Gray Fox Circle. If this is not acceptable the applicant would like to keep the house on Lot 1 as it
exists today and he may come back at a later time with a proposal for this lot.
