studies have shown that these improvements will be able to service the traffic generated by
the project without exceeding the City's level of service limitations on neighboring
intersections. To be consistent with the City's general plan the PUD for the project re uires
traffic anal sis for each new development proposal on the project's remaining undev"ec/ouped
p. arcels an~that mitigation measures be included as conditions of the proposed develo ment
If necessary to avoid a Level of Service D (91% of capacity) on specified neighboring
intersections. Future projects can be denied if the traffic analysis shows that the addition of
d
the traffic generated by the proposed evelopment would cause one of the key intersections tb
exceed Level of Service D and there are no mitigation measures that can be implemented to
improve the effected interesection to 86% capacity or better. However, the City's right to
deny such projects has been conditioned upon the City conditioning future projects on the
neighboring undeveloped land with the same limitations.

measures discussed above, but has retained the right to protest and litigate all matters other
than the validity of the formation of the district, including, but not hmited to the type of
improvements, costs, and allocation of the costs of the improvements among the various
properties.

In addition, the PUD re uires the Developer to participate in te provision of parks and
recreation facilities for the needs of the employees of business parks in the city. The project's
participation shall be equal to its pro rata share of the capital cost of acquiring and developing
such park and recreation facilties.
