Sphere of Influence beyond the current line

Ms. Michelotti indicated her question was regarding the Wildland Overlay District that
goes beyond the existing Sphere of Influence.

Mr. Swift explained where the Sphere of Influence is currently located. The area Ms.
Michelotti was questioning is the "planning area". It is not an area that the City is planning for,
as it is outside our Sphere and the Urban Growth Boundary line and is not intended to be
developed. We are not changing our Sphere of Influence at all. The law allows a city to
include in its General Plan any area that it feels is important for its planning purposes.

KUki PrOl~rl;y_ on Foothill Road

Ms. Michelotti indicated she had concerns regarding designating this property rural
density on the lower part. She was felt it was possible the city could be opening itself for
litigation. She wanted to leave it low density. She requested that the Kuki property be voted
on separately. She did not feel the Council would be setting any high expectations by doing
that. She wants the property to remain designated as it was. The geotechnical work will
determine what happens there and she did not feel it was appropriate to change the designation.
She wanted to be on record as opposing this.

Mr. Pieo felt separating the property would invite legal action.

Freda Collins, 367 West Angela Street, indicated she had owned the property for a long
time and the zoning has been changed three times. There are 231 acres and they only want to
develop 33 acres. First they were allowed 35 units, then reduced it to 20, now the city says
only 8 units will be allowed. That is not fair. There will not be a big impact on traffic or the
environment. She wants the property left as it is.

It was moved by Ms. Michelotti, seconded by Ms. Mohr, to vote on the Kuki
property separately from the other Foothill Road properties.
The roll call vote was as follows:
AYES: Councilmembers - Dennis, Michelotti, and Mohr
NOES: Councilmember Pico and Mayor Tarver
ABSENT: None
ABSTAIN: None

Urban Growth Boundary_

Ms. Michelotti wanted the General Plan to include wording that says "and will be
reviewed at subsequent comprehensive General Plan reviews" and then continue with the motion
as previously voted on. She wanted people to know that when the General Plan is reviewed,
the Urban Growth Boundary will be considered for validation or change. If this goes to a vote

07/09/96 -43-
