beyond. From there on, the Committee changed the recommendation either to agriculture or
rural density residential. The problem with saying we will treat it the way the South Livermore
Plan did is the South Livermore Area Plan simply calls it a transition area and does not give any
density, other than policy language that says it should be a gateway to the wine country.

Ms. Mohr felt that is what we are dealing with, the gateway question, and it begins there.
Mr. Swift indicated Council can do what it wishes with the property west of the dump.

Mr. Tarvet referred to the letter received from Mr. McGuire which proposed that his
property be separated from the rest of the Vineyard Corridor. His property is located on the
west side of the dump and there does not seem to be controversy regarding those properties.

Ms. Mohr felt it was okay to leave those out and focus on the problem areas.

Mr. Swift stated there is an issue with regard to the area to the west of the dump. In all
the preliminary discussions with those property owners, because they were included in the area
covered by the proposed Specific Plan, staff was taking the position that any of the benefits that
accrued through the development of the entire corridor in terms of extra infrastructure
improvements or parkland, etc. would potentially allow them to get beyond the midpoint of their
own density range, which blended from 3-4 units per acre. If they were taken out of the study
area, under the new Council policies, they would probably not be able to get beyond the
midpoint of the density range. Mr. McGuire and the rest of the owners want to be at that upper
end. If you include them in the specific plan area, they have the potential to use the community
park and other kinds of things to boost density. If you take them out, their density will be cut
in half.

Ms. Michelotti felt there was a motion approved at the last meeting. There is no
representation here tonight from this area. She wanted to make sure that the people who were
here the last time be notified that there has been subsequent action, so they can be prepared for
the July 15 meeting.

Mr. Tarvet wanted it to be clear that staff and the public understand what he is trying
to do and that there is no flip/flop at the final hour.

The roll call vote was as follows:
AYES: Councilmembers - Dennis, Pie, o, and Mayor Tarvet
NOES: Councilmembers - Michelotti and Mohr
ABSENT: None
ABSTAIN: None

07/09/96 -42-
