Ms. Dennis felt there were a couple of difficulties. Sometimes the park fee is sufficient
and then again there is a need for a neighborhood park and the park dedication fee is not
sufficient to do that. Other times, there is no problem because there is an in lieu fee paid and
there is already a neighborhood park serving the area. Where you need a park and the fees are
not enough, the City may have to buy land that has an approved subdivision map for it and that
increases the land value.

Ms. Mohr said that was done for the Nielsen Park. Three separate projects had land
dedicated to build the park that serves the area.

Mr. Tarver said that only works if the developer agrees to dedicate the land. He is
concerned that if the land is not dedicated and the value of the land is significantly higher, then
the City cannot designate where it wants the park because it increases the difficulty of
negotiating for park land. He felt it was a "comp" issue. If the City wants to build a park in
area four, it ought to be able to assess a fee based on what it costs to buy five acres in area four.

Ms. Michelotti felt the planning process makes sure that if there is no existing
neighborhood park to serve an area, that the proposed project include some provision for a park.

Ms. Bengtson indicated that was true.

Ms. Mohr indicated that was done when the Shea Homes project came forward. It was
not required to dedicate the entire five acres, but the City wanted a park there, so a portion was
required to be dedicated and the balance of the park land was acquired from subsequent
developers in the area.

Ms. Dennis asked if an additional criteria could be added that says in the event a
neighborhood park is needed and the park in lieu fees are not sufficient to purchase the land, that
an additional fee may be required?

Mr. Pico felt his proposal gives that flexibility; it sets a minimum fee and gives an option
to look at increasing the fee if the value of the land or the need is there. He felt the Park and
Recreation Commission should review this before Council takes action.

Mr. Tarver wanted to change the membership of the ad hoc committee. He wanted to
add two citizens at-large and remove the Chamber of Commerce representative. The businesses
are not paying for the parks; the community and developers are.

Ms. Michelotti indicated that if Council is going to consider something quite different,
then she supported sending it back to the Park and Recreation Commission for review.
However, she felt that the City should require a park from development where necessary.

09/17/96
-10-
