the property owner having the right to appeal that by having a specific appraisal done on that
property. If there were a combination like that, we could have a minimum fee set under the
current standards, but there would be a mechanism to help the City avoid the circumstances we
saw in the Hacienda Business Park. The fees paid were far less than what was necessary to buy
an acre of land in the Business Park. Did staff consider this approach?

Ms. Bengtson said that combination was not considered. There was a proposal to allow
a developer to seek an appraisal as is done in other cities. But other cities are not using land
value as a basis for fees. In Pleasanton's situation, staff did not feel that was necessary because
it does use land value as a basis.

Ms. Mohr asked if the 25 % concept would also apply to property that is 25 % lower in
value.

Mr. Pico did not support that.

Mayor Tarver asked if there was anyone to speak on this item.

Bert Felix, 2860 Garden Creek Circle, asked where the fees go when they were collected
from projects where there is no park constructed?

Ms. Bengtson indicated if there is a park in existence that will serve new residential
construction, the park fees are put into the community park development fund. That includes
money from all over town and contributed to the improvements for the Sports Park, the Tennis
and Community Park, Amador Park, and the Aquatic Center.

Ms. Acosta indicated these funds are kept track of in separate accounts and it is clear in
the budget exactly where the funds are allocated.

There were no further speakers on this item.

Ms. Michelotti felt the suggestion of Mr. Pico was actually a parcel by parcel evaluation
where one development park fees may be different from another, rather than having a set fee
for all. The Committee that reviewed this issue tried to establish sections of the City for land
values and that was rejected.

Ms. Bengtson indicated that was true. The concept was rejected because of the small
number of comparable sales available for each section.

Ms. Michelotti felt that as available land becomes more rare, there may be smaller
parcels and the price may go up. The yearly analysis should reflect that higher valuation and
the fees could be adjusted.

09/17/96
-9-
