Mr. Swift said that maximum only applied to new projects and there were no requests
from any of the new projects to move units further out. The units Signature requested to be
moved to an earlier year is not a reallocation and does not count against them.

Mr. Tarver referred to the entitlement issue. Growth Management allocations seem to
be like gold and the developers will not release them. Not only will the apartment development
not happen, there is also an application to rezone the property to office use.

Ms. Michelotti felt the staff report was difficult to understand and appreciated the
comments of the growth management committee. Moving the Signature Properties units is
helpful and she hopes the program will more accurately reflect reality. The staff report does
give details of what has actually been built and how many permits were pulled. Those numbers
are considerably less than what is included in the projections.

Mr. Pico understood the difficulties of this program, but felt people were playing games
with the program. The City is no where near the targets set by the General Plan. In 1995, 100
units were moved for the Case Avenue project which are really being built in 1996. The St.
Johns Place is another example of permits issued in 1995, but construction didn't happen until
1996. The Stanley Seniors project is another example. There are about 220 units that were
allocated for 1996 and you add that to 650 units projected for the current year. That is 870 units
and he does not feel those kinds of games should be played. The numbers do not reflect what
is happening with development in the community.

Mr. Tarver agreed. There have been too many examples of playing with the numbers
to make the units fit and he is looking forward to completion of the study to look at how to
handle the situation. Given the current process and the rules that apply, he felt the committee
did a remarkable job of getting the numbers down.

The roll call vote was as follows:
AYES: Councilmembers - Dennis, Michelotti, Mohr, and Mayor Tarver
NOES: Councilmember Pico
ABSENT: None
ABSTAIN: None

09/17/96
