Nancy Pozzebon, 2808 Longspur Way, appreciated Council keeping the neighbors in
mind since so many problems had occurred with that particular Center. She attended the
meeting called by Mark Garetz. She appreciated the fact that he had contacted the owner of the
shopping center and encouraged her to come speak with the neighbors. They met in her
backyard, in the glare of the lights from the shopping center. The owner had not realized the
glare was so strong. Two lights are now turned out. They gate issue and other problems were
discussed. A communication problem still exists between the residents, shopping center
management and the City planners. She has no objection to the type of operation that Mr.
Garetz wants to operate. He has even offered the residents a chance to view the operation.

Mark Garetz, 3015 Hopyard Road, told Council he had met with the neighbors and that
they did not have a problem with the business. He is sensitive to the odor issue and did not
realized anyone would object to a bakery-like smell. He does not have a problem with the
formal requirement of odor control filters on his stack and volunteered to have them installed.

Ms. Michelotti asked if the filters could be retro-fitted at a later date or was it cost
effective to do it now.

Mr. Garetz had not checked into the cost of installing carbon filters. Staff checked with
a brew pub in Palo Alto that had an odor problem. They had the carbon filters retro-fitted and
it seemed to correct the problem.

Mayor Tarver felt the ordinance should have this condition because of possible odor
problems.

Mr. Garetz stated staff mentioned performance standards and that there was a way to
measure odor.

Mr. Swift replied that that standard is used by the Air District. The ordinance is
structured to try and gauge the time period when there would be actual emissions of odor into
the air. If the odors are objectionable, then action would be allowed under the standard
conditions of approval. Staff could judge when to require filters for a microbrewery.

Mr. Garetz had a letter drafted by himself and amended by Mr. Gades with the signatures
of the neighbors (including Reverend Hunt) saying they support the ordinance as recommended
by the Planning Commission.

There being no further speakers, Mayor Tarver closed the public hearing.

It was moved by Ms. Michelotti, and seconded by Ms. Mohr, to introduce Ordinance
1665, to read by title only and waiving further reading thereof, to approve RZ-95-05, amending
Section 18.08 and Section 18.44 of the Pleasanton Municipal Code to address brew pubs,
microbreweries and self-brew establishment, as recommended by the Planning Commission
except eliminating the square footage limitation for microbreweries.

10/03/95
