218

It was moved by Ms. Scribner, and seconded by Ms. Mohr, that
Resolution No. 92-225 be adopted, encouraging the Bay Area Air
Quality Management District to adopt the proposed Regulation 13 -
Rule 1 (trip reduction requirement for large employers).

The roll call vote was as follows:
AYES: Councilmembers Mohr, Pico, Scribner and Mayor Tarver
NOES: None
ABSENT: None
ABSTAIN: None

Item 12b
Resolution Callinq for a Special Election to Fill the Vacant
Council Seat of Ben Tarvet

Mayor Tarver asked that items 12b and 12c be considered
together as one item.

Ms. Scribner opposed this request.

Mr. Pico asked that if the items were going to be considered
separately, item 12c be considered by Council first.

Ms. Mohr was ready to proceed with agenda as presented.

Mayor Tarver stated that he wanted both elections
consolidated. He did not want a special election for the Council
vacancy without dealing with the referendum at the same time.

Mr. Pico also wanted the two elections combined. He was
willing to wait until June to do so if needed. He did not think
that it was in the best interest of the community to wait but felt
that it was in the best interest of the community in terms of
expenditures. He would not support having a March special election
to fill the vacant Council seat and then a separate election for
the Kottinger Hills referendum.

Mr. Roush referred to the Council's Policies and Procedures
and explained that the general rule is that once the agenda is set
it can only be changed by the majority of the Council.

Ms. Scribner recommended following the agenda as presented.

Ms. Mohr commented that the vacant seat needed to be filled as
soon as possible.

Mayor Tarver agreed.

12/1/92 16
