220

It was moved by Ms. Scribner, and seconded by Ms. Mohr, to
call for a Special Election on the next regularly scheduled
election date, March 2, 1993, to fill the vacant seat on the City
Council.

The roll call vote was as follows:
AYES: Councilmembers Mohr and Scribner
NOES: Councilmember Pico and Mayor Tarver
ABSENT: None
ABSTAIN: None

Mr. Pico believed that it was not in the best interest of the
City to appoint a person to fill the vacancy on the Council seat.

It was moved by Ms. Mohr, and seconded by Ms. Scribner,
declaring that Council would fill the vacant City Council term by
appointment and directing staff to advertise for applicants, with
a two week application period and a one week interview time.

The roll call vote was as follows:
AYES: Councilmembers Mohr and Scribner
NOES: Councilmember Pico and Mayor Tarver
ABSENT: None
ABSTAIN: None

Because no majority vote could be obtained, the item was
continued.

Item 12c
Kottinqer Hills - Referendum or Council Initiative

Mayor Tarver reiterated that it would in the best interest of
the community to combine elections to decide this issue. This
would reduce the cost of having two special elections. The
difference between this process and the referendum process is the
verification of signatures.

Ms. Scribner believed that this was a neighborhood referendum
and it should be kept that way, which means it should follow the
process.

Ms. Mohr agreed. She added that if the Council puts it on the
ballot, then it would become a Council initiative which is not what
this is about.

Mayor Tarver commented that if there was a majority on the
Council that is now in opposition to the development, then it would
be appropriate to make an initiative out of it. If Council wanted
to stand by the decisions of the previous Council, then the process
would be a referendum.

12/1/92 18
