221

Mr. Pico believed that a Council initiative would save the tax
payers money and resolve this issue in a timely manner.

Mr. Roush explained that after the signatures are turned in,
the City Clerk must verify that the requisite number of signatures
have been obtained, which will take a period of time to do. It was
not appropriate for the City Clerk to conclude that because there
are 4,500 signatures obtained, and only 3,500 are needed, that the
3,500 are valid without going through the normal process of
checking them. If, however, it is found that the requisite number
of signatures are valid and the requisite number have been
obtained, then the City Council could vote to repeal the ordinance
without putting it to a vote. The Council could initiate an action
this evening to place before the voters the repeal of the
ordinance.

Ms. Mohr asked if it would be legitimate to put this matter on
the November election with the School Board. She then asked if it
would be cost saving.

Mr. Roush answered yes to the first question, if Council
called for a special election in March for the Council seat. The
City would split the cost with the School District if the elections
were combined in November.

Larry Snyder, President of the Kottinger Hills Homeowners
Association, 1375 Bordeaux Street, pointed out that there was
approximately 4,100 signatures collected as of this evening. He
did support having an election so that the citizens could vote on
the issue and supported expediting the process.

Gary Purnell, 2472 Via De Los Milagros, urged Council to
expedite this process. He did not support the project and felt
that a lot of work had already been put into this process. He
believed that having an election in November was delaying the
process too long.

Martin Inderbitzen, 5000 Hopyard Road, represented the Lin
family, pointed out that the costs that may be incurred by this
referendum or special election was not caused by the Lin family.
He did not believe that it was appropriate to assume that there was
enough signatures at this time because they had not yet been
verified. Mr. Inderbitzen was disappointed to have the two
election issues combined because he felt that the Council election
was the more important issue.

Mr. Pico asked if it were possible to have the election of the
City Council vacancy scheduled for March and also have referendum
scheduled for March but contingent upon the certification of the
signatures. If there was not enough signatures collected, then
could the Council delete the item from the ballot. He then asked
if Council could pass a resolution that would indicate that Council

12/1/92 19
