12

Property Tax and Jail Bookinq Fees

Ms. Acosta informed the Council that the Alameda County Board
of Supervisors had passed the property tax and jail booking fees.

13. REPORTS OF THE CITY ATTORNEY
Item 13a
Settlement of Pleasant Villaqe Associates v. City of Pleasanton and
Related Claims for Damaqes

Mr. Roush presented his report (SR 91:14) regarding the
matter.

Mr. Henry Hatton, 3963 Fairlands Drive, owner of the property
immediately adjacent to the Pleasant Village Associates Complex,
stated that Mr. Thomas should not get a $29,000 settlement from the
City because he violated the provisions of Measure X. He proposed
that Mr. Thomas get his relief from his architect, who also did the
Measure X plans.

Mr. Hatton then pointed out that the uses allowed under
Measure X does not include video stores and, therefore, the video
store should not be allowed to exist in the complex. He added that
neither Measure X nor the City ordinance defines "fast food
restaurants" and that although the City has always considered
eating places with tables and chairs as sit-down restaurants even
if food is offered for take out, some restaurants that allow
seating, like McDonald's and Burger King, are considered fast food
restaurants. He made the distinction that in "fast food
restaurants," customers order food at the counter while in "sit-
down restaurants," customers sit down and are served. He
recommended that the City look into the possibility of hiring an
outside consultant, to be paid for by the proponents of Measure X,
to define "fast food restaurants."

Mr. Hatton also mentioned that many trucks still park on
Pimlico Drive and suggested that a fine be included in the "No
Truck Parking" sign to discourage truck parking.

Mr. Mercer requested staff to look into the matter.

Mr. Tarver indicated that he could not support the resolution
because he does not believe that Mr. Thomas has no responsibility
in the matter.

- 12 -
1-8-91
