464

It was moved by Mr. Brandes, and seconded by Mr. Butler, that
Ordinance No. 1484 be introduced, to be read by title only and
waiving further reading thereof, approving PUD-90-11, the
application of James Yes for planned unit development rezoning and
development plan approval which will allow an approximately 14,732
sq. ft. site to be subdivided into four separate lots located on
991 Rose Avenue, as set forth in the Staff Report.
The roll call vote was as follows:
AYES: Councilmembers Brandes, Butler, Mohr, Tarver and Mayor
Mercer
NOES: None
ABSENT: None
ABSTAIN: None

Item 6e
Z-90-427, Application of Paul and Karen Alvafez to Reqra~e a
Portion of the Rear Yard, Re-Landscape, and Export Materials from
the Site Located at 2924 Amoroso Court (Lot 7, Vintaqe Heiqhts I=)

Mr. Swift presented his report (SR 90:352) regarding the
matter.

Mr. Mercer declared the public hearing open on the
application.

Mr. Butler and Ms. Mohr abstained from the discussion because
they own stock in Amador Valley Savings and Loan, which was the
project developer and which remains partly responsible for the
public improvements on the project.

Mr. Paul Alvarez, 2924 Amoroso Court, stated that he had
submitted an application for a landscape plan and the installation
of a pool on his property. He indicated that the landscape would
include changing the variety and quantity of trees currently
planted in property. He added that privacy could be maintained
with fewer trees and that the variety of the trees currently
planted would not be compatible with the pool decking that is being
planned. He said that he cannot see into his neighbors' rear yard
from the highest elevation in his backyard or from his house, while
his neighbors have a clear line of sight to his yard from their
second story window. He requested that Council approve his
application, since it conforms for the most part with the CC&Rs,
and that he be allowed to remove the twelve Myoporum laetum trees
and related irrigation from his property and replace them with
three or four trees, with no specifications on their maturity
levels. He offered the trees to City for other landscaping
projects it might have. He added that if the number of trees to be
planted is not negotiable, some other party should take the

9-4-90

- 10 -
