465

responsibility for the costs associated with the number and
maturity level of the trees, as requested by his rear yard
neighbor.

Mr. Mercer requested Mr. Swift to explain the conditions of
the application.

Mr. Swift stated that there are currently twelve trees in Mr.
Alvarez' yard and that Mr. Alvarez is suggesting that three or four
trees would be sufficient to screen the back of his rear property
line; the existing trees would be removed, and new trees would be
planted. He added that staff has recommended that the trees to be
planted be 15-gallon trees for the fast growing variety and 24-inch
box trees for the much slower growing trees. He indicated that
while twelve fully matured trees would be too numerous for the
backyard, it would take a long time for the new trees to reach the
breadth and height of the trees now planted in the yard.

Mr. Mercer noted that the Staff Report indicated that the
neighbors had no objections to Mr. Alvarez' plan, as conditioned by
staff. He inquired if the Kwans' backyard was big enough to could
accommodate more trees.

Mr. Swift replied that the Kwans' house is one of those houses
staff is looking at for additional landscaping.

Mr. Mercer commented that since Mr. Alvarez has offered his
trees to the City, the Kwans could probably use them in their
backyard if they so desired. He asked Mr. Swift if the Kwans are
in agreement with Mr. Alvarez' plan.

Mr. Swift replied that the Kwans know that Mr. Alvarez is
proposing 15-gallon or smaller trees but that they probably are not
aware that Mr. Alvarez is proposing only three to four trees. He
added that the Kwans had indicated that while 15-gallon trees are
acceptable, they would prefer to have trees that are the same size
as those that are being taken out.

Mr. Alvarez pointed out that the Kwans' backyard could very
easily accommodate additional trees and that he was amenable to
moving the trees to their yard. He stated that the privacy issue
is moot and has no connection with the maturity level of the trees
he would plant since he cannot see into their backyard.

Mr. Tarver commented that he was under the impression that
Mr. Alvarez and the neighbors were in agreement about what would be
done in his backyard. However, it appears that Mr. Alvarez in not
in agreement with staff recommendation and that the neighbors do
not approve of Mr. Alvarez' plan.

9-4-90

- ll -
