466

Mr. Alvarez explained that his original application was for a --
fewer number of trees than now exists, but that the Kwans had
indicated to the Planning staff that they preferred that the same
number of trees be planted, which he does not agree with. He added
that if he agreed with the staff recommendation to plant the same
number of trees, there should be no condition on the size or
species of trees to be planted, which staff does not agree with.

There being no further testimony, Mr. Mercer declared the
public hearing closed.

Mr. Tarver stated that he would like to keep the same
conditions for all the properties in the area; however, some of
those conditions would not apply to Mr. Alvarez' case. He
indicated that he would prefer to have a plan worked out for both
neighbors rather than support staff recommendations which do not
satisfy the applicant.

Mr. Mercer indicated that he would support Mr. Alvarez' plan
because Mr. Alvarez' lot does not have the privacy problems of the
other lots in the area.

Mr. Tarver pointed out that the reason the neighbors were not
present at the Council meeting could be because they believe the
matter has been settled by the Staff Report. He stated that the
neighbors should be informed if Mr. Alvarez' plan is approved since '
it would not be what staff recommended.

Mr. Mercer inquired if any meetings were held between the two
neighbors and staff.

Mr. Swift replied that staff met with Mr. Alvarez and with the
Kwans separately but that Mr. Alvarez had given a copy of his plans
to the Kwans and the two other neighbors.

Ms. Acosta stated that the Kwans could be notified of the
decision, and they could request a reconsideration of the decision
at the next Council meeting if they do not agree with that
decision.

It was moved by Mr. Mercer, and seconded by Mr. Brandes, that
Resolution No. 90-164 be adopted, approving Z-90-427, the
application of Paul and Karen Alvarez to regrade a portion of the
rear yard, re-landscape, and export materials from the site located
at 2924 Amoroso Court (Lot 7, Vintage Heights II) as set forth in
Mr. Alvarez' plan.

9-4-90

- 12 -
