461

that staff would recommend denial of the project based on the issue
of the 150-foot setback requirement being proposed by the Foothill
Road Corridor Overlay District Study (FRCODS). Both the Design
Review Board and the Planning Commission denied the project, to
which new conditions which had not been previously discussed with
the applicants had been added.

Mr. Harvey indicated that only selective comments of the
Design Review Board and the Planning Commission had been included
in the current Staff Report. He pointed out that there were three
major issues of dispute: (1) adequate amenity to justify the
proposed density increase; (2) provision for internal circulation
system on the west side of Foothill Road to accommodate future
development; and (3) the 150-foot setback requirement. With regard
to the issue of amenity, he explained that the landscape scenic
easement area of 12,200 sq. ft. was designed to reflect and enhance
the open, rural characteristics of the area and minimize the impact
of water shortage during a prolonged drought period. He noted that
it was large enough for five houses, two of which had pools. He
added that the purpose of the scenic easement was to avoid having
a soundwall on that portion of Foothill Road, which is prohibited
by the Landscape Maintenance Agreement.

With respect to the internal circulation system, Mr. Harvey
stated that the original plan had a 20-foot wide road which the
Planning staff wanted increased to 28 feet when the lots were
reduced from six to five. He indicated that a 28-foot road would
adversely impact the look and flavor of the rural setting.
Additionally, the existing ll-foot road was sufficient for the past
16 years, and a 20-foot road would give sufficient room for cars to
travel unimpeded. Staff had also proposed cutting the road at the
lower half of the property connecting with the Romero property,
creating a road parallel to Foothill Road. He proposed the
alternative of creating another artery road similar to Jorgensen
Lane off of Foothill Road between the Stevenson and Olsen
properties.

With regard to the 150-foot setback requirement, Mr. Harvey
mentioned that none of the six houses between Bernal Avenue and the
Jorgensen development abutting Foothill Road conform to setback
requirement mandated by the FRCODS. He pointed out that the
setbacks of the houses along Foothill are inconsistent and that the
FRCODS provides for flexibility when applicable. He requested that
the setback requirements for the project be modified to provide the
same rights and privileges enjoyed by the neighbors. He then
handed the Councilmembers copies of a proposed modificanion to his
plan.

9-4-90

- 7 -
